Acceptable Use and Conduct Policy

This Acceptable Use and Conduct Policy (“Policy”) governs your use of the products and services provided by Zapp S.L. and its affiliates (“Zapp”, “we”, “us”, or “our”) as well as our websites and their subdomains, including any successor websites (collectively, the “Zapp Sites”).
We may update this Policy from time to time by publishing a revised version on a Zapp Site.
By using the products or accessing a Zapp Site, you agree to the latest version of this Policy.

You must not use, or permit or enable others to use, the products or any Zapp Site:

for any unlawful, intrusive, infringing, defamatory or fraudulent purpose (including, for example, phishing, pyramid schemes, or website mirroring);

to infringe or encourage the infringement of the rights of others;

to incite, promote or facilitate violence, terrorism or other forms of serious harm;

to transmit or publish any content that promotes or enables child sexual exploitation or abuse, is pornographic, harassing, grossly offensive, hateful (including material targeting any individual or group on the basis of race, ethnic origin, nationality, religion, sex, gender, sexual orientation, disability, or medical condition), or is otherwise abusive or unacceptable, as determined by Zapp at its sole discretion;

to compromise the security, integrity or availability of any network, system, device, software or service, whether operated by Zapp or any third party;

to upload, store or distribute viruses, malware, worms, Trojan horses, corrupted files or other harmful or deceptive content;

to misrepresent your identity or the origin of any content (including through spoofing, phishing, impersonation, manipulating headers or other identifiers, or falsely suggesting any sponsorship or affiliation with Zapp or any other entity);

to engage in multi-level marketing or pyramid promotional schemes;

to seek or exploit vulnerabilities in Zapp systems or to bypass security or access controls.

You must not use the products or any Zapp Site:

to send, facilitate, or support the sending of unsolicited mass communications (including email, SMS, push notifications or any other form of direct messaging) for marketing or promotional purposes, commonly referred to as “spam”; including, but not limited to:

• sending communications that breach the EU ePrivacy Directive, the General Data Protection Regulation (Regulation (EU) 2016/679 – GDPR), or any applicable anti-spam, consumer protection or electronic communications legislation;

• impersonating Zapp, another individual, or using misleading sender information or addresses, including the creation of false accounts for the purpose of disseminating spam;

• harvesting or scraping data from websites, applications or platforms to collect email addresses or other user identifiers;

• sending emails through open relays or unauthorised third-party servers;

• sending marketing messages to recipients who have opted out, unsubscribed, or not provided valid, informed consent as defined under the GDPR;

• selling, exchanging, disclosing or sharing personal data, including email addresses or phone numbers, without a lawful basis and the data subject’s ongoing and informed consent;

• sending communications to individuals or organisations with whom you have no prior relationship or without a lawful basis for contact;

• using automated tools or surreptitious means to compile lists of addresses (e.g., scraping, bots, data mining);

• failing to maintain accurate and up-to-date opt-out lists, or continuing to send communications in breach of known withdrawal of consent.

If you use the Services to send emails, text messages or similar communications, you must comply with all applicable laws and best practices regarding commercial messaging, including the lawful processing of personal data, the use of consent and the provision of clear opt-out mechanisms.

Conduct Guidelines – Interacting with Zapp Employees

Zapp is proud of the diversity, professionalism, and global reach of its workforce and customer base.
We are committed to fostering respectful, honest and collaborative relationships and have zero tolerance for any form of bullying, harassment, discrimination or abuse towards our employees.
This applies to all forms of communication, including but not limited to phone calls, emails, messages, support chats, video calls and written correspondence.

Accordingly, the following conduct is strictly prohibited:

intimidating, shaming or harassing any employee by any means;

using degrading, offensive or demeaning stereotypes or language relating to race, nationality, gender, sexual orientation, disability, religion, or any other protected characteristic;

persistent or unwanted contact that is abusive, threatening or disrespectful.

Zapp reserves the right to limit or terminate support interactions, suspend access, or take other appropriate measures in the event of abusive conduct towards its staff.

Investigation and Enforcement

Zapp reserves the right to investigate any suspected breach of this Policy and may remove or disable access to any content or service component that, in its reasonable opinion, violates this Policy.

You agree to cooperate fully with Zapp in remedying any actual or suspected violation.
Zapp may report any activity that it reasonably believes may contravene applicable laws or regulations to the relevant regulatory, law enforcement, or supervisory authorities.
Such reporting may include the disclosure of Customer Data or other personal data, subject to compliance with applicable data protection legislation, including the GDPR.

Zapp may also cooperate with law enforcement, regulatory bodies, or other appropriate third parties in investigating and prosecuting unlawful conduct. This may include providing relevant system or network data, logs or identifiers where legally permitted.

Where there is a material or repeated breach of this Policy, or where a Customer fails to respond to communications within a reasonable timeframe, Zapp may:

immediately suspend access to any product, Zapp Site, or related service;

terminate any agreement under which this Policy is incorporated, with or without further notice;

take any other action reasonably necessary to prevent harm or ensure compliance.
